SMS TERMS & CONDITIONS (TRANSACTIONAL PROGRAM)

These SMS Terms & Conditions apply ONLY to the LiftShift SMS-based intake, scheduling, and estimating application (the “SMS App”) used to support participating home-improvement contractors.
IMPORTANT: This Privacy Notice does NOT apply to LiftShift’s separate professional services / data services work, which is governed by separate agreements and policies.

PROGRAM OPERATOR & DESCRIPTION
Program Operator: LiftShift LLC (“LiftShift,” “we,” “us,” or “our”).
The SMS App provides automated, transactional text messaging to assist with service inquiries you initiate by calling or texting a participating contractor’s phone number.
MESSAGE TYPES YOU MAY RECEIVE (EXAMPLES)
Depending on your interaction, you may receive:
A response acknowledging your missed call or initial text
Requests for your address and service details
Preliminary estimate information and/or a link to view estimate details
Appointment scheduling and confirmation messages
Appointment reminders
Service-related follow-ups directly related to your inquiry
We do not send marketing or promotional SMS messages to end users through this program.
CONSENT / OPT-IN
By texting a participating contractor’s phone number, or by calling that number and then continuing the interaction via text, you consent to receive SMS messages related to your service inquiry, including messages sent using automated technology.
Consent to receive messages is not required as a condition of purchasing goods or services from LiftShift.
MESSAGE FREQUENCY
Message frequency varies based on your interaction and the status of your service inquiry (for example, scheduling or reminders).
MESSAGE & DATA RATES
Message and data rates may apply. Check your mobile plan with your wireless carrier.
OPT-OUT (STOP)
You can cancel SMS messages at any time by replying: STOP
After you send STOP, we will send a confirmation message and you will no longer receive SMS messages from this program unless you start a new interaction.

CARRIER DISCLAIMER
Carriers are not liable for delayed or undelivered messages.
PRIVACY (NO MARKETING SHARING)
We use SMS information to provide and support your service inquiry.
We do not share phone numbers collected for SMS communications with third parties or affiliates for marketing or promotional purposes.

ESTIMATES ARE PRELIMINARY (IF PROVIDED)
Any estimate provided through the SMS App is preliminary and informational only. Final scope and pricing are determined by the contractor after appropriate review and/or on-site inspection.
CONTRACTOR RELATIONSHIP DISCLAIMER
Participating contractors are independent businesses. LiftShift provides a communications and estimating platform and does not perform construction work. Any agreement for services is between you and the contractor.
PROHIBITED USES
You agree not to use the SMS App to transmit unlawful, harassing, threatening, or fraudulent content or to interfere with the operation of the service.
DISCLAIMER OF WARRANTIES
The SMS App is provided “as is” and “as available,” to the maximum extent permitted by law.
LIMITATION OF LIABILITY
To the maximum extent permitted by law, LiftShift will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the SMS App.
If liability cannot be excluded, LiftShift’s total liability for claims relating to the SMS App will be limited to the amount you paid to LiftShift for the SMS App in the twelve (12) months prior to the event giving rise to the claim (if any).

We may update these Terms from time to time. The “Last Updated” date reflects the most recent version.
